Buy-It-Now:
All Buy It Now listings include the 10% buyer's fee in the price listed except for real estate listings. If you choose to buy an item using the "Buy-It-Now" option, all auction terms apply. All items are sold as-is / where-is with no warranty or guarantee, please inspect items before purchasing. If you choose the Buy-It-Now option, payment is due immediately. If you do not contact us immediately following the purchase, the item will be relisted, and your bidding privileges may be revoked. Once transaction is complete, you will have 14 days from time of purchase to remove the item or storage fees may be applied unless approved by ISA.
Internet Payment Terms:
Full Settlement Is Due Within 3 Business Days of the Day of Sale for Bidders, Credit Card On File Will Be Charged If Payment Is Not Made Within 3 Business Days.
All items must be removed by December 20th, 2024.
Any item located offsite are by appointment only unless stated otherwise in item listing. Contact details will be included in the paid in full invoice. The ISA Yard will be open: December 2nd, 2024 – December 20th, 2024, Monday-Friday, 8 AM - 4 PM (All trucks must be in the yard 30 minutes before close). Yard will be open Saturday, December 14th from 8 AM - 12 PM and will closed on all other Saturdays and Sundays.
No items may be removed without check with bank letter of guarantee, wire transfer or payment by cash or credit card.
Accepted Payments Are Cash, Wire Transfer, Cashier's Check/Money Order, Personal/ Business Check with bank letter of guarantee, Visa, Mastercard, Discover, American Express (3.5% Fee Applies to Credit Card Purchases).
All bids are final. All items are sold as is / where is, buyer is responsible for disassembly and removal of items. Inspection prior to bidding is recommended and available. Buyer is responsible for all freight, handling costs, and taxes where applicable. Land/Property Terms:
Land Lots may be paid with the following: Wire Transfer, Bank Check, Personal/Business Check with Bank Letter of Guarantee
10% down is required on the land with 72 hours of the close of the auction. Closing costs are covered by the buyer. Closing will happen within 60 days of the auction unless agreed upon by all parties. Auction company will choose title company and if needed the surveying company. It is automatically acknowledged by registering that you have personally inspected the property, hired an agent to inspect the property, or waived your right to inspect the property. Placing a bid creates a contractual agreement to purchase the property at the high bid price plus a Buyer’s Premium and any additional fees included in closing the real property transaction.
Buyer’s closing costs can include new boundary survey, title search fees, title insurance premiums, recording fee of documents, Buyer’s prorated items and any other fees required for closing. Seller’s closing costs are limited to their portion of the prorated tax, revenue stamps and the cost of deed preparation. It is understood that the purchaser must hire an attorney to act as a settlement agent, which includes but is not limited to the preparation of settlement statement, distribution of funds and recording of all required documents. The Purchaser shall have the right to have a title examination made at the expense of the Purchaser.
All property in this auction is selling “AS-IS, WHERE IS” with all faults, if any. Integrity Sales & Auction LLC makes no representations or warranties, expressed or implied, concerning the property. Descriptions of the property are believed to be correct, but are not guaranteed and are provided by the Seller. It is the Buyer’s responsibility to conduct any inspection prior to the auction. All due diligence periods end the date the auction is schedule to end, and prior to the end of the auction. It is possible that the property being sold is subject to restrictive covenants and homeowner’s association rules, regulations and dues. Ultimately, it is the Buyer’s responsibility to inspect all aspects of the property before placing a bid. No sale shall be invalidated by the Buyer as a result of he/she not conducting their own inspection prior to placing a bid or doing due diligence. It is automatically acknowledged by placing a bid that you have personally inspected the property, hired an agent to inspect the property or waived your right to inspect the property. All parcels are guaranteed access. If there is no access to a parcel, a 33' easement to public access will be granted at the discretion of Integrity Sales & Auction.
These Terms and Conditions constitute a CONTRACT between you, the bidder, and us, the Auctioneer. Do not submit any bids unless you understand and agree to ALL terms of this contract. Integrity Sales & Auction LLC shall be known individually and collectively as Auctioneer, or Auction Company. All bidders must be 18 years of age or older to bid on this auction. Anyone under 18 must be accompanied by an adult. All bidders and others participating in this auction agree that they have read these terms and agree to be bound by and abide by these terms thereby. All property is sold as is, where is, without any warranty or guarantee, expressed or implied. ALL SALES ARE FINAL AND WITHOUT RESERVE. THERE ARE NO REFUNDS, EXCHANGES or REFUSALS. As the highest bidder, you are the buyer and are bound by the terms and conditions of this agreement and sale. Bidder and his or her agents and employees agree to assume all risks of damage to person or property. Bidder acknowledges that Integrity Sales & Auction LLC does not have any responsibility or liability for the website(s) used for Internet bidding. Seller acknowledges that Integrity Sales & Auction LLC may not have any control over the website(s) and cannot guarantee its operation or performance. There are occasional interruptions and delays relating to the use of the Internet and the Website. Furthermore, Integrity Sales & Auction LLC shall not be held liable (for lost profits or special damages) or responsible for the function of the website or its inability to function. Buyer acknowledges that hardware malfunctions, software malfunctions, viruses, and similar issues do occur and are beyond the knowledge, scope, and control of Integrity Sales & Auction LLC. Integrity Sales & Auction LLC reserves the right to deny any person for any reason permission or access to bid.
Contact & Communications Consent. By registering for this auction bidder provides consent to Integrity Sales & Auction LLC to send electronic or printed advertisements from time to time, including but not limited to email and text message/SMS marketing and printed advertisements. Bidder can unsubscribe from digital marketing at any time. Notice must be provided to our office to be removed from print mailing lists.
Bidder and his or her agents and employees specifically release and forever indemnify Auctioneer, its employees, agents, and assigns, from any liability and causes of action. In no event shall a bidder or buyer hold the Auctioneer responsible for having made or implied any warranty or merchantability or fitness for any specific purpose. The Auctioneer is acting solely as the agent for the Seller(s) and is not responsible for any acts or omissions of its principals. The Auctioneer shall assume no liability for representations made, or information provided by the Seller(s). The Auctioneer does NOT inspect equipment and makes no claim as to the condition of any vehicles or equipment. Some equipment may be described as started or ran. This is for informational purposes only and is a representation of a past occurrence. There is no warranty or guaranty that the equipment will start or run again. Bidders should not make buying purchases based on this information. Years, descriptions, makes, models, hours, miles, and other advertised information are not guaranteed. The Bidder acknowledges and accepts that the Auctioneer shall, without prejudice, accept no liability in respect of any alleged or actual error(s) and/or omission(s). Bidders must bid based on their own pre-auction inspection of all items. Neither the Auction Company nor its principals shall be liable for any defect in or condition of premises on which the auction is held. Auctioneer may bid on behalf of absentee bids and/or itself. Owner's and Owner's employees may bid on all items in the auction. Should you allow others to bid under your number, you will be fully responsible for all bids they make as though you made them yourself. Removal of any and all items shall be at the expense, liability and risk of the purchaser. The Seller and the Auctioneer reserve the right to withdraw items from sale before or during the auction without prior notice. Persons attending the preview or inspection period, auction or during the removal period assume all risks of damage, injury, or loss to their person and or property, and release the Auctioneer and the Auction Company from liability thereof. No items may be removed without payment by check with bank letter of guarantee, wire transfer, cash, or credit card. Check payments without bank letter of guarantee must clear the bank before items can be removed from site. Items not removed by December 20th, 2024 will be considered abandoned, without refund or recourse to the bidder. Bidder accepts full responsibility for all purchases made and holds the Auctioneer free from any liability including theft of items. By participating in this auction, you agree to pay the removal costs of any unclaimed items that you won in the auction. In the event bidder fails to pay in full within 3 days of the auction, the bidder/buyer agrees to indemnify the owner and/or Auctioneer against all loss or damage upon sale, together with cost and expense thereof, including attorney's fees, and agrees to pay the Auctioneer interest of 1.5% per month on the unpaid balance. The bidder / buyer agrees to reimburse the Auctioneer for all expenses incurred in the collection of any unsatisfied debt in conjunction with this auction. Auctioneer reserves right to repossess any items in the event of non-payment due to a bad check. Any disputes resulting in legal matters shall be addressed in Lincoln County Circuit Court. By registering for any auction, the bidder agrees to be added to the Auctioneer's email list. Payment is due to the Auction Company within Seventy-Two (72) hours of the conclusion of the auction. Integrity Sales & Auction LLC reserves the right to update the terms and conditions at any time. Payments may be applied to any outstanding balance. Terms and conditions are subject to change.
